Impact of feminicide as a criminal figure: progress and challenges in Latin America

Abstract

Femicide is one of the most serious problems in Latin America, where high rates of gender-based violence persist. This article analyzes the challenges in implementing femicide as a legal concept, assessing its progress and obstacles. It raises the question of whether its criminalization has contributed to reducing rates of violence in the region. Using a qualitative approach, a systematic literature review was conducted, considering regulations, academic studies, and institutional reports. Methods such as documentary analysis, content analysis, and legal hermeneutics were employed. The findings show that, although the criminalization of femicide has been an important regulatory advance, its effectiveness is limited by impunity, a lack of training in the judicial system, and the persistence of structural and cultural barriers. To ensure its implementation, it is essential to strengthen prevention and punishment mechanisms through comprehensive strategies, greater resource allocation, and regional cooperation. This study highlights the need to harmonize legislation and strengthen state commitment to eradicating gender-based violence and ensuring access to justice for victims.
