Abstract

The objective of the study was to analyse the policies and mechanisms of environmental preservation in the face of mining exploitation in Ecuador, through a critical evaluation of the current regulatory framework, in order to identify its effectiveness and possible legal gaps. To this end, a descriptive documentary research methodology with a qualitative approach was used, which included the systematization of the main studies carried out on the subject. The analysis showed that mining has historically been present in the country, which has motivated the implementation of various measures aimed at environmental protection, since it is the main affected by this activity. The results showed that the policies and mechanisms applied so far have not achieved their purpose, thus generating a negative and continuous environmental impact due to mining operations.
