EXECUTION AND COMPLIANCE WITH PROTECTION ACTION JUDGMENTS WITHIN THE JURISDICTION OF THE PASAJE CANTON

This article critically examines the structural and procedural deficiencies in the enforcement of court rulings derived from protective actions in the canton of Pasaje, El Oro province, Ecuador, exploring how the gap between constitutional norms and their practical application undermines the effective guarantee of fundamental rights. As a substantive alternative, the implementation of specialized judicial enforcement units is proposed, drawing on successful national experiences that highlight the importance of specialization, dedicated resources, and coordination to overcome management deficits. Finally, the article argues that constitutional justice must transcend the mere issuance of rulings to consolidate an effective rule of law through a system that ensures full compliance and sanctions negligence, thereby securing the tangible realization of rights and strengthening institutional legitimacy in vulnerable regional contexts such as Pasaje.
