Abstract

Workplace harassment is a social and legal phenomenon that violates fundamental labor rights and reveals the insufficiency of protective measures in Ecuador. Despite the existence of constitutional and legal provisions guaranteeing dignity, integrity, and workplace safety, their practical application remains limited, resulting in administrative and judicial processes that re-victimize the complainant. This study analyzes, from a legal and social approach, the shortcomings of institutional mechanisms to prevent, punish, and repair the damage caused by workplace harassment. It examines current legislation, institutional practices of re-victimization, and the need to reform labor regulations to incorporate psychosocial protocols and effective protection procedures.
