/ Impact of the use of artificial intelligence for decision-making in the Ecuadorian criminal justice system

This article aims to argue for the most suitable mechanisms for using artificial intelligence (AI) in criminal cases and proceedings in Ecuador, highlighting its potential to improve the efficiency and accuracy of the justice system. To achieve this, a qualitative research approach is employed, supported by analytical-synthetic, exegetical, and inductive methods. The findings reveal that, although AI can optimize the criminal justice system, its adoption in Ecuador is limited and faces significant ethical and legal challenges. Therefore, a comprehensive regulatory framework is proposed that balances innovation and the protection of rights, with specific regulations for AI systems in criminal proceedings, judicial oversight, training for judicial officers, and mechanisms for the continuous evaluation and updating of the legal framework as technology advances. In this way, the Ecuadorian criminal justice system can use AI to make its processes more efficient, accurate, transparent, and equitable, without compromising fundamental rights or due process principles, thus consolidating a more reliable justice system for citizens.
