THE HOURLY EMPLOYMENT CONTRACT AND LABOR RIGHTS IN THE ECUADORIAN CONTEXT

Abstract

The present study focuses, on one hand, on analyzing how hourly work was a form of labor precarization that persisted in Ecuadorian legislation for nearly a decade, from 2000 to 2008. On the other hand, it aims to explain how other labor and civil contractual arrangements currently function practically as hourly labor contracts, which, with some minor differences, also represent forms of labor precarization. The study examines the violation of labor rights in hourly contracts and identifies points of convergence between these contracts and the aforementioned ones by comparing and verifying their essential elements. Special attention is given to two contractual figures: first, the permanent part-time contract, which shares many similarities with the hourly labor contract; and second, the disguised contract for the provision of professional services.
